Spouse awarded One half percent of FERS Retirement Annuity


Spouse was awarded One half percent of FERS in 2014. I retired on Fed Disability Retirement in 2018. In reading RI38-116 it looks like Spouse will need to send the EQ Order to OPM. The order reads “Defendant awarded One half percent of 103 months of marriage divided by my total service 264 months (as of 2018). I don’t understand the calculation at all how do I figure this out?

Honestly, there is not enough information in the question for me to answer. However, I will give you some information which might assist you. When the employee took the disability retirement, on the form SF-3107, the retiree would have had to have checked the YES box that a former spouse was awarded a portion of the annuity AND attached a copy of the decree. Depending on how detailed the decree was, and how it was worded, a COAP may or may not be required. Unless the COAP or decree/settlement expressly protected a disability retirement, OPM will divide a disability retirement as if it were a regular retirement just as stated in the order. It’s more likely one half of the share attributable to the marital period or the one-half percent was stated as 50% of the 1% typical FERS benefit.
